These General Terms and Conditions (hereinafter referred to as “GTC”) of Bondo Inh. Bonderer, apply to legal transactions concluded via the online shops www.mybondo.com, www.jomevo.com, www.bond-airone.com. The online shops just mentioned are operated by BONDO Inh. Bonderer.

Bondo Inh. Bonderer reserves the right to amend these GTC at any time. The version of these GTC in force at the time of the order shall be authoritative in each case and may not be unilaterally amended for this order. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not be recognised unless Bondo Inh. Bonderer expressly agrees to their validity in writing.

The term “customer” refers to any natural or legal person who maintains business relations with Bondo Inh.

The offer of products and services in the online shop is aimed exclusively at customers with their place of residence or company headquarters in Switzerland or Liechtenstein.

Deliveries are made exclusively to addresses in Switzerland or Liechtenstein, unless a different delivery address is agreed individually.

Offers are valid as long as the product can be found in the respective online shop and/or stocks last.

For all product orders with a minimum age requirement of 18 years, the customer confirms compliance with these legal provisions with his order.

Orders in quantities not customary in the household may be rejected without justification.

Bondo Inh. Bonderer strives to keep its online shops always innovative and up-to-date. We provide our services professionally and carefully in accordance with these GTC and the other contractual provisions. Bondo Ihn.Bonderer strives to constantly offer its customers the latest products. The opinions expressed by experts and ambassadors on products reflect their personal views.

 

Price quotations

The sales prices shown in the online shop are in Swiss francs (CHF). The sales prices represent market prices. The sales price includes all taxes (in particular value added tax), as well as any recycling fees and copyright levies. In addition, shipping costs may be incurred in accordance with our shipping conditions.

Bondo Ihn. Bonderer reserves the right to change the prices of the products and services offered at any time. The price in the online shop at the time of the order is decisive for the conclusion of the purchase contract.

Additional services subject to a charge (e.g. splitting an order) will be listed separately on the invoice.

 

Product information, availability and warranty information

Bondo Inh. Bonderer always endeavours to provide customers with the best possible information and clarification about the products and services offered. This information is partly obtained directly from the manufacturers or from experts or our ambassadors and is compiled in a clear and customer-friendly manner for the customers. Any information about products, services, recommendations, warranty conditions and warranty periods published in the online shop or on printed materials is therefore without guarantee and not to be understood as an assurance. In particular, no liability can be accepted for the accuracy, completeness and up-to-dateness of the information. Illustrations of products in printed materials (flyers, catalogues, etc.) and in the online shop are for illustration purposes and are not binding. Furthermore, no liability is assumed for advertised products if these were sold on another platform to which the online shop links. In this case, the respective general terms and conditions of the respective shop always apply.

Bondo Inh. Bonderer attaches great importance to carefully maintaining the availability information and to displaying it as correctly and accurately as possible. Many of the products offered are sourced from manufacturers in Switzerland. However, due to production or delivery bottlenecks or due to incorrect stock data, there may be delays in delivery. All information on delivery times is therefore not binding and without guarantee and may change at any time and without notice. Delivery may also be completely impossible if a product can no longer be manufactured or supplied. In this case, a delivery impossibility occurs in accordance with the subsection “Conclusion of Contract” of these GTC.

 

Conclusion of contract

The products, services and prices published in the Bondo Inh. Bonderer online shop are deemed to be an offer (quotation). However, this offer (quotation) is always subject to the (resolutory) condition of an impossibility of delivery or an incorrect price quotation (on the part of the manufacturer or Bondo Inh. Bonderer). This means that non-delivery may occur due to articles no longer being available. It is also possible that we have not indicated the correct prices in the shop.

The contract is concluded as soon as the customer places his order via the online shop, by telephone, fax or e-mail. The arrival of the order in the case of an online order is indicated to the customer by means of an automatically generated order confirmation by e-mail. Receipt of the automatically generated order confirmation does not constitute a promise that the product is actually available or can be delivered. It merely indicates to the customer that the submitted order has been received and that the contract has thus been concluded, which is subject to the resolutory condition of non-delivery.

If one of the above-mentioned (resolutory) conditions occurs, the contract will be dissolved immediately and without the involvement of the parties. We shall inform our customers of such dissolution immediately. If the product has already been handed over beforehand, the ownership automatically reverts to Bondo Inh. Bonderer and the customer is obliged to return the product (with repayment of the price paid by Bondo Inh. Bonderer). If the product has not yet been handed over, the customer is neither obliged to pay the purchase price nor to accept it. As a result of such a cancellation of the contract, Bondo Inh. Bonderer is not obliged to make a replacement delivery, but will always endeavour to do so.

 

Terms of payment

The customer undertakes to pay with the payment options provided by Bondo Inh. Bonderer. The current payment options and payment method fees can be seen in the Shipping & Payment Conditions and are shown in detail in the order process.

If payment is made by credit card or other instant means of payment, the charge will be made when the order is placed.

 

Retention of title

Products delivered to the customer remain the property of Bondo Inh. Bonderer until the purchase price has been paid in full. The customer automatically grants Bondo Inh. Bonderer the right to enter any retention of title in the retention of title register.

 

Default of payment

If the customer fails to meet his payment obligations in whole or in part, the customer is in default with all outstanding amounts owed immediately and without reminder. Bondo Inh. Bonderer reserves the right to suspend all deliveries. In addition, Bondo Inh. Bonderer reserves the right to withdraw from the affected orders.

Bondo Inh. Bonderer may remove the “invoice” payment option at any time from customers who are in arrears with payments or who become aware of other circumstances that reduce their creditworthiness. In this case, the customer can only place orders with the other available means of payment in accordance with our Shipping & Payment Conditions.

Bondo Inh. Bonderer may cancel or suspend an order if
(a) a customer is or appears to be uncreditworthy
(b) has more than one outstanding reminder; or
(c) there is reasonable suspicion of improper intent.

 

Cancellation and Termination of Contract

Orders placed by the customer with Bondo Inh. Bonderer are binding in accordance with the “Conclusion of Contract” section of these GTC. The customer is then obliged to accept the ordered service/products. Subsequent changes and cancellations are possible in certain cases, but are at the discretion of Bondo Inh. Bonderer and may be associated with handling costs, which will be charged to the customer.

If the customer does not take delivery of the products within two weeks despite an obligation to take delivery, Bondo Inh. Bonderer may terminate the contract and charge the customer for the handling costs.

In the event of an impossibility of delivery in accordance with the section “Conclusion of contract” of these GTC, the customer shall have the right to cancel the contract at the earliest four weeks after the agreed delivery date. In the event of cancellation due to non-delivery, Bondo Inh. Bonderer shall refund to the customer any amounts already paid in advance. If payment has not yet been made, the customer shall be released from the obligation to pay. Further claims due to delay in delivery or failure to deliver are excluded.

 

Exchange and return

Articles can be returned to Bondo Inh. Bonderer within 10 days of the invoice date. Please note: It is imperative that the goods are returned new, unworn, unwashed and in their original condition including label(s) and original packaging as well as with the invoice. Returns can be sent back by post. The costs for the return shipment are borne by the customer. It should be noted that in the case of express deliveries, the express surcharge cannot be refunded. Furthermore, please note that we cannot accept any responsibility for lost or delayed returns. We therefore recommend that you track the parcel using the parcel tracker. Responsibility is transferred to us as soon as the return reaches our warehouse. We will send the customer an email confirming receipt of the return.

If the above products are defective, incomplete or in poor condition, they can be returned. In this case, Bondo Inh. Bonderer will endeavour to find an equivalent replacement. If this is not possible, the money already paid will be refunded. The exchange and return of the above-mentioned products are not possible. Only in exceptional cases and after consultation can an exchange or return be made. The price basis for all returns and exchanges is always at most the current price valid on the day of the return or exchange. Products that have been specially ordered for the customer, as well as individually configured products, are completely excluded from return or exchange.

Delivery

Products delivered or collected must be checked immediately for correctness, completeness and intactness. Should faults or damage (visible or invisible) occur, these are to be reported by the customer to Bondo Inh. Bonderer immediately after discovery, but at the latest within 7 calendar days after receipt of the consignment or acceptance of the products. For the further procedure of claims handling, the consignment must be kept in the condition in which it was delivered and the product must not be used.

 

Return of goods from repair

If the customer wishes to return goods to Bondo Inh. Bonderer for repair, this will be done at the expense and risk of the customer to the respectively announced place of return. The products must be sent with all accessories, properly packed and insured. The return must be accompanied by a detailed description of the fault or defect and a copy of the invoice.

 

Service and warranty

The two-year warranty period from the date of delivery always applies. The invoice receipt is valid as a warranty certificate.

In the event of a warranty claim, the manufacturer regularly provides for repair, replacement with a product of equal value or compensation in the amount of the current value, but no more than the purchase value of the product. In any case, the decision lies with the manufacturer.

If the manufacturer’s warranty exceeds the warranty provided by Bondo Inh. Bonderer, the customer is required to contact the manufacturer directly. The customer acknowledges that the products are not manufactured by Bondo Inh. Claims under manufacturer’s warranty are granted exclusively by the manufacturer. The examination of a warranty claim is the sole responsibility of the manufacturer.

A guarantee can only be provided if there are no reasons for exclusion such as damage due to incorrect manipulation or mechanical damage. This includes, for example:

• damage caused by the elements

• moisture damage

• damage caused by falls and impacts

• excessive wear and tear

• defects resulting from interventions or modifications

Parts subject to wear and tear, batteries, rechargeable batteries, lamps, etc. are excluded from the warranty or have a reduced warranty period.

Products marked as “test model” in the shop are demonstration products. This means that these products have already been used and tested. These products may have slight optical defects, which is why they are sold at a reduced price. These optical defects are excluded from the guarantee. With regard to functionality and usability, the normal warranty conditions of the manufacturer apply.

The warranty exchange or warranty repair does not lead to an extension of the original warranty period.

In all other respects, the statutory warranty provisions apply in accordance with Art. 197 ff. OR. The customer has a right to rectification of defects, but not to rescission or reduction.

 

Liability

Claims for damages arising from non-delivery, from termination of the contract, from breach of contract, from poor performance due to culpa in contrahendo and from unlawful acts are completely excluded against Bondo Inh. Bonderer and against the vicarious agents of Bondo Inh. Bonderer, insofar as no intentional or grossly negligent action is involved.

ATTENTION: Any liability for indirect damage, indirect damage and consequential damage resulting from the use, through faulty performance or failure of performance of goods delivered by Bondo Inh. Bonderer is excluded.

 

Data protection

The data protection declaration is an integral part of these GTCs. By accepting these GTCs, the customer also agrees to the data protection declaration. Customer data can be exchanged within Bondo Inh. Bonderer.

 

Place of jurisdiction and applicable law

The place of jurisdiction is the registered office of Bondo Inh. Bonderer, 7000 Chur GR. The contract is subject to Swiss substantive law.
